    Terms of Service

    The agreement governing your use of Devhelion. Fair, transparent, and designed to protect everyone.

    1. Acceptance of Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and Devhelion AI ("Devhelion," "we," "us," or "our") governing your access to and use of the Devhelion platform, including our website at https://Devhelion.ai, software, APIs, and related services (collectively, the "Service").

    By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

    If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you as an individual and the organization.

    2. Service Description

    Devhelion provides consent-based telemetry collection, analytics, and insights for developers using AI-assisted coding tools, including:

    • Telemetry Collection: With your consent, collection of AI tool interactions including code, prompts, and responses
    • Automatic Redaction: Pre-upload scanning and removal of PII, secrets, and credentials with user alerts
    • Analytics Dashboard: Visualization and analysis of your AI coding patterns and productivity metrics
    • Insights Generation: Automated insights and recommendations based on your usage patterns
    • Team Analytics: Aggregated analytics for team collaboration and productivity tracking
    • Custom Knowledgebase: Integration of your team's knowledge and best practices
    • API Access: Programmatic access to your telemetry data and analytics
    • GitHub Integration: Optional commit tracking for enhanced insights

    Consent-First Architecture

    Devhelion only collects data with your explicit consent. You control what is collected and can disable collection at any time. All data undergoes automatic redaction before upload to remove sensitive information. See our Privacy Policy for details.

    3. Account Registration and Eligibility

    3.1 Eligibility

    To use the Service, you must:

    • Be at least 13 years old (or 16 in the European Economic Area)
    • Have the legal capacity to enter into binding contracts
    • Not be prohibited from using the Service under applicable laws
    • Comply with all local laws regarding online conduct and acceptable content

    3.2 Account Creation

    To access certain features, you must create an account. You agree to:

    • Provide accurate, current, and complete information
    • Maintain and update your information to keep it accurate
    • Keep your password secure and confidential
    • Notify us immediately of any unauthorized access or security breach

    4. User Responsibilities and Acceptable Use

    4.1 Acceptable Use

    You agree to use the Service responsibly and in compliance with these Terms. You may:

    • Use the Service for personal or commercial purposes as permitted by your plan
    • Integrate Devhelion with supported AI coding tools
    • Control what data is collected through consent settings
    • Access and export your own data
    • Share aggregated team analytics with team members

    4.2 Prohibited Activities

    You agree NOT to:

    • Violate laws or use the Service for illegal purposes
    • Circumvent technical limitations, rate limits, or access controls
    • Reverse engineer, decompile, or disassemble any part of the Service
    • Scrape or crawl data beyond API limits
    • Interfere with the Service or other users' access
    • Exploit vulnerabilities without authorization
    • Upload viruses, malware, or malicious code
    • Impersonate others or misrepresent your identity
    • Spam or abuse support channels
    • Share accounts or API keys (except within authorized teams)
    • Resell or redistribute the Service without permission
    • Infringe intellectual property or privacy rights of others

    Consequences of Violation

    Violation of these Terms may result in suspension or termination of your account, legal action, and cooperation with law enforcement. We reserve the right to investigate suspected violations.

    5. Data Collection and Consent

    5.1 Consent Requirement

    You must explicitly consent to data collection before Devhelion collects any telemetry data.When you enable telemetry collection, you consent to the collection of:

    • Source code and file contents involved in AI interactions
    • Prompts and questions you give to AI coding assistants
    • AI-generated responses, suggestions, and code
    • Metadata about your AI tool usage

    5.2 Automatic Redaction System

    Before any data is uploaded, Devhelion automatically scans and redacts:

    • Personally Identifiable Information (PII): emails, phone numbers, addresses, SSNs
    • Secrets and credentials: API keys, passwords, tokens, private keys
    • Environment variables: .env files, connection strings, cloud credentials
    • Authentication tokens: OAuth tokens, session tokens, JWTs

    User Alerts Before Upload

    If sensitive information is detected, you receive an alert BEFORE upload showing what was redacted. You can review the redactions and cancel the upload if needed.

    5.3 Withdrawing Consent

    You may withdraw consent and disable data collection at any time using:

    After disabling, no further data will be collected. Previously collected data remains available until you delete it.

    5.4 Data Ownership

    You retain all ownership rights to your data. We only have a limited license to process your data to provide the Service. This license ends when you delete your data or close your account.

    6. Intellectual Property Rights

    6.1 Your Data and Content

    You retain all ownership rights to your data and content. This includes:

    • Your source code
    • Your prompts and AI interactions
    • Your telemetry metadata
    • Custom configurations and knowledgebase content
    • Any content you create using the Service

    6.2 Devhelion Intellectual Property

    Devhelion and its licensors own all rights to:

    • The Devhelion platform, software, and technology
    • Our trademarks, logos, and brand assets
    • Documentation, content, and design
    • Proprietary algorithms and analytics methods

    6.3 Feedback and Suggestions

    If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free license to use, implement, and commercialize them without compensation or attribution.

    7. Subscription, Payments, and Billing

    7.1 Subscription Plans

    • Free: No payment required, subject to usage limits
    • Pro: $6.99/month, billed monthly or annually
    • Teams: $24.99/month per team (5 seats), billed monthly or annually
    • Enterprise: Custom pricing, contact sales

    7.2 Billing and Payment

    • Payment via credit card, debit card, or other accepted methods through Stripe
    • Subscriptions renew automatically at the end of each billing period
    • We'll notify you at least 30 days before any price increases
    • Prices exclude applicable taxes unless stated otherwise
    • Failed payments may result in service suspension

    7.3 Cancellation and Refunds

    • Cancel anytime via your dashboard or by contacting support
    • Access continues until the end of your current billing period
    • Generally no refunds for partial months or annual subscriptions
    • Refunds may be provided at our discretion for technical issues
    8. Service Availability and Modifications

    8.1 Service Availability

    • Uptime target: 99.9% for paid plans (excludes scheduled maintenance)
    • We'll notify you of scheduled maintenance in advance
    • The Service is provided "as is" without availability guarantees

    8.2 Service Modifications

    We may modify, update, or discontinue features with reasonable notice for material changes. Continued use after changes constitutes acceptance.

    9. Disclaimers and Limitation of Liability

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    AI-Generated Insights Disclaimer

    Insights generated by Devhelion are for informational purposes only. AI-generated recommendations may be incomplete or inaccurate. You are responsible for reviewing and validating all insights before acting on them.

    OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

    10. Termination and Suspension

    10.1 Termination by You

    You may terminate your account at any time via your dashboard or by contacting support. You have 30 days to export your data after account closure.

    10.2 Termination by Devhelion

    We may suspend or terminate your account if you violate these Terms, fail to pay fees, or your account poses a security risk.

    10.3 Effect of Termination

    Your right to access the Service immediately ceases. All data is permanently deleted within 30 days. You remain liable for any fees incurred before termination.

    11. General Provisions

    11.1 Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Devhelion regarding the Service.

    11.2 Amendments

    We may modify these Terms from time to time. We'll notify you of material changes via email or prominent notice. Continued use after changes constitutes acceptance.

    11.3 Governing Law

    These Terms are governed by the laws of the United States. Disputes not resolved informally may be subject to binding arbitration.

    11.4 Severability

    If any provision is found invalid, it will be limited to the minimum extent necessary, and the remaining provisions remain in full effect.
